These terms and conditions apply to all users of Sparkleberry’s website, www.sparkleberry.co. By accessing or using the website, you agree to the terms outlined in this User Agreement. If you do not agree, you must not use the website or services.

Products

Sparkleberry is a creative marketplace that offers a variety of art and craft products, primarily handmade items, which are subject to availability. Products are listed and sold by independent vendors through the platform. Sparkleberry reserves the right to remove, update, or discontinue any product at any time without prior notice.

Responsibility for product descriptions, quality, legality, and authenticity lies with the individual vendor.

Pricing and Payment

• All prices are listed in UAE Dirhams (AED) unless otherwise specified.
• Prices may change without prior notice.
• Sparkleberry accepts payment through secure third-party processors, including credit/debit cards, PayPal, and other gateways.
• Payments are processed securely and are subject to prevailing exchange rates (if applicable).

Shipping

• Shipping costs are calculated at checkout based on shipping method, weight, and destination.
• International orders may incur customs duties, taxes, or import fees, which are the responsibility of the buyer.
• Sparkleberry is not liable for customs delays or additional charges applied by destination countries.

Returns and Refunds

As most items are handmade and unique, Sparkleberry does not generally offer refunds, returns, or exchanges. Exceptions apply only in the following cases:

1. Non-Delivery: If the order does not arrive, Sparkleberry will refund the full paid amount.
2. Damage During Delivery: If the artwork arrives damaged, Sparkleberry will refund the paid amount for the item and delivery fees, subject to proof of damage.

To claim a refund, the buyer must:

• Notify Sparkleberry within 24 hours of receiving the item.
• Provide clear photographic evidence of the damage via email.

We strongly advise customers to check their order at the time of delivery.

Intellectual Property

• All content on Sparkleberry’s website, including text, graphics, images, and logos, is the property of Sparkleberry (www.sparkleberry.co) unless otherwise stated.
• Users may not reproduce, copy, or distribute content without Sparkleberry’s prior written consent.
• Vendors are solely responsible for protecting their own intellectual property rights in the artworks and crafts they create. Sparkleberry is not responsible for enforcing or monitoring vendor copyrights.

Privacy Policy

Sparkleberry respects your privacy. We collect only the information necessary to process orders and enhance customer experience. Personal data is protected using industry-standard encryption and will not be shared with third parties except:

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
